Nigeria’s funniest House Member, Hon. Patrick Obahiagbon never ceases to amaze us with his drammatic grammar usage.
Check out what he said on the current ASUU strike issue battling higher institutions in the country;

Education is a transformation tool in any given society and
it should be held in high esteem. The future of Nigeria education has
been relegated by various stakeholders (including, F.G and ASUU) in
the sector. It is unfortunate that the government that is vested with
the responsibility of ensuring sustainable development in all
ramification through education claimed to have skiped some allowances
of teachers in higher institutions of learning during the preparation
of it fiscal budget for 2013. A contract or agreement that is duly
signed by parties is deemed to be binding on the parties involved, but
the Nigeria government that should uphold this has failed to implement
such agreement which it entered into with ASUU in 2009, which in turn
leads to a breach and violation of contract.
The Nigerian National Policy on Education specify the standard and
goals of higher education in Nigeria, but the government has failed in
meeting up to such standard in terms of infrastructural development,
research development and facilities, also in building a total,
functional and a self reliance education in the youths in order to
avert crises and high rate of social menace and moral decadences.
The Academic Staff Union of Universities (ASUU) on the other
hand has failed to accept the fact that there exist social
stratification of the “Haves” and Have Nots” in the society as the
“Haves” i.e the rich does not want access to quality or eminence
education by the “Have Nots” i.e the poor, thereby igniting incessant
struggle between the two class and the universities staff also belong
to the class of the “Have Not” i.e the lower class in which the common
parent and students are included, (poor against poor).
The act of frequent declaration of strike action by ASUU is not at
all time the solution for government to meet up their demands because
the end product of the strike action often falls back on the lower
class in the society i.e the “Have Nots” . The claim of ASUU is the
government refusal to grant the lecturer’s allowances and
extra-payment on student’s project supervision, examination
supervision, workload allowances, etc… The question is that with all
the salaries and municipal revenue generated by public universities,
are they able to meet up to the minimum local standard talk much of
international standard?. The rich men children are flown abroad to
obtain a qualitative and valuable education. The Nigerian professors
are merely theoretical in nature and dispositions, however, lecturers
believe in examination and regurgitation of knowledge from students,
they also perpetuate all manners of academic corruption which is
systemic. Some of the universities lecturer’s performance can not be
equated to their rewards or benefits as their job performance is
relatively low in contrast to their economic return. They do no longer
assume that the rewards of teachers are in heaven as so many of them
strive for various kinds of political appointments in both state and
federal level under the disguise of “ASUU”. The poor man and students
should not suffer for this. Education has become a game and teddy bear
in the hands of F.G and ASUU. A bachelor degree programme that should
last for four(4) years is now been elongated to five(5) years, thereby
increasing the cost on education for both parent and individual
student in a highly competitive and relatively low returns on
investment on education society like Nigeria.
In conclusion, ASUU and F.G should recognize that the future of
this country and the education of its citizens for overall development
are premised on the formulations and implantation of positive
educational and social policies. However, I hereby appeal to the
conscience of ASUU and Federal Government of Nigeria to immediately
speed up actions in resolving and implementing the October 2009 joint
agreement between them to rescue the nation’s educational system.

I'm sorry Sir, I cant see your invoice on our system
One of the things that is most talked about in the industry is late payments. It is a buzzword, another idealism that doesn’t transpire to the actual working practices seen every day in this industry.
I have to say that late payment has to be the topic that sends me over the edge most often… not financially but mentally.
When you run a business and it doesn’t matter what kind it is, there are 3 key stages that I have found in business, they are:
1. Finding the work and winning it
2. Actually doing the work
3. Getting paid for the work.
Every time that you have done business with people in the construction industry I have always found that the middle one is the easiest.
When you consider that throughout the industry there are lots of different people employed, all having different qualifications and coming from different training backgrounds, but there is one special particular group of people I want to focus your mind on in this blog post and that is the men and women who work in the ACCOUNT DEPARTMENTS of Main Contractors.OMG!!!
These people are the most powerful people in the supply chain – yes you read that right – forget the SubContract Buyers, the Supply Chain Managers, the QS’s and anyone else with a nice sounding title it is Mr ADEWUMI and Miss ADEDUNYE from SubContract Accounts!!!!
Now when you picture these people in your mind’s eye just thing about the ones you have dealt with in the past, think back to all the times you have spoken to them, the lovely conversations you have shared and the trusting relationship you have built up. (Hmm I don’t think so.)
Let me run through the experiences sample that someone have had when trying to get paid – see if this looks familiar
work finished
send invoice with payment due date
payment due date passes without a word
chase payment speak to accounts ( 1st call ) – first question they ask without fail is ‘who did you send the invoice to?’, then they proceed to say : ‘well I haven’t seen that invoice, you will need to go back and get them to authorise it’ – ‘OK’ you say and you do that
speak to accounts ( 2nd call ) – you say – ‘chasing up the payment RE xxx’ and they say ‘ oh haven’t got that invoice through yet from X , phone back at the end of the week’
speak to accounts ( 3rd call ) – you say ‘ yes it is me again chasing the payment’ and they say ( AND HERE IS THE PUNCHLINE ) ‘ Oh yeah , we’ve got that now’ you say ‘ YES!!, when will it be paid’ and they say‘ well, unfortunately we have missed this month’s cheque run and so it won’t go through until next month now – sorry ‘
at this point you usually get off the phone and swear to yourself that I will never work in construction again and make a promise to yourself that I will retrain to be a traffic warden who share the same ethical values and reasoning abilities that everyone working in an Accounts department I have ever spoke to has.
One of the biggest questions that burdens me when I go to sleep at night is, Where do these people that work in the accounts departments all train ? - what part of the syllabus for accounting technicians or accountants teaches them to all have the same attitudes, the same tactics and the same tricks to avoid paying people on time. BE UNDER NO ILLUSION THAT IS WHAT IT IS ALL ABOUT, NOT PAYING ON TIME.
When they drafted the Housing Grants, Construction and Regeneration Act 199x did all those clever people who wanted to ensure late payments be counteracted take into account the ‘call centre’ mentality of the staff in Accounts Department.
( Imagine a construction related firm ) If I were to submit an invoice next year to a Contractor and then to phone up their accounts department when it doesn’t get paid and to be put through to a call centre in a developing economy and to be told ‘sorry you have missed the cheque run’ I would say ‘ Oi Message to Contractors – sort out those people in the accounts and tell them to buck up their act !! or I’ll give you a parking ticket !!

Is that a BQ or a Christmas Turkey

One of my recent tweets was a wish list of twelve things that I would like for Christmas and which hopefully will transpire through the forthcoming year.
Of that 12 things, there is one in particular that I really would like to come true the most. I have been a good Quantity Surveyor student all year, I didn’t swear at any Architects, I didn’t approximate tonnes to a whole number and I didn’t talk back to my seniors.
So please AYO deliver this : The one I want to come true is ‘ Contractors to give more time for QS’s to produce BQ’s’.
Let me set the scene here, this is an experience you could have daily as you do a lot of work for Contractors and time is just one factor.
A tender comes into the Contractor, it is a design and build contract so there is usually a specification, a set of drawings (you will be lucky if they are slightly more detailed than the planning issue) and a set of Employer’s requirements. There is no bill of quantities only a contract sum analysis.
The Contractor needs a bill of quantities produced and so he invites a few Quantity Surveyors to submit a fee to produce a BQ. Contractors want more than builders quants now; they want a detail BQ produced, measured to SMM7.
Let me point out the problems associated with that, by the way Contractors know these problems exist, however sometimes they choose to ignore them.
Issue 1. Design information : the drawings that come with even traditionally procured tenders are rarely up to stage F of the RIBA plan of work – Production Information. This means that as QS’s producing bills of quantities we cannot act outside of our limitation we are only able to make a reasonable assumption and qualify it or exclude. You cannot measure detail quantities on this level of information.
Issue 2. Time : the continual squeeze on time available to tender comes down from the top i.e. the Employers QS , the Project Managers or the Architects that are administrating the tenders. Contractors need to give this feedback to them.
Issue 3. Cost : I am more than aware than the cost of producing bills of quantities at tender stage is a financial gamble for contractors, they may expend a huge amount on a tender and not win the contract. But Contractors need to realise that the cost of bills of quantities in today’s market place is usually calculated on hourly rate x hours and it is really as simple as that. Some Contractors think they can get a bill knocked out for a rate that would be less than the hourly rate they employ their own QS’s for and they think that you can squeeze two working weeks i.e. ten days into five.
Issue 4. Quality. The first three are the key ingredients for the BQ Christmas dinner, drop one of them and you haven’t got the right recipe. To get things right you need to pay a reasonable fee, you need to give the Quantity Surveyor as much time as possible to produce the BQ and you need ensure that your expectations for the returned BQ are reflective of the information you have sent out.

Moral of this Christmas story – if you don’t give the QS enough time to produce a BQ – you are going to get it back like an undercooked Christmas Turkey!!!

A Shepherd’s Musings: Week 19 & 20 – God is Wise
Recently I had the privilege of sharing James 1:5-6 with a brother in Christ who felt the need to be wiser. The expression of enlightenment and encouragement that shone over his face as he read this verse was amazing, “If any of you lacks wisdom, let him ask God, who gives generously to all without reproach, and it will be given him. But let him ask in faith, with no doubting, for the one who doubts is like a wave of the sea that is driven and tossed by the wind.” We then bowed our heads and prayed, taking heed to the warning to ask with trust and confidence in God. Sensing and knowing our lack of wisdom, and praying for wisdom are good. By doing so, we will see more of God’s wisdom.
Wisdom comes from God because God is wise. What is wisdom? According to J. I. Packer, “Wisdom is the power to see, and the inclination to choose, the best and highest goal, together with the surest means of attaining it. Wisdom is, in fact, the practical side of moral goodness. As such, it is found in its fullness only in God. He alone is naturally and entirely and invariably wise” (Knowing God, pg.90). A wise man once said, “The fear of the LORD is the beginning of wisdom, and the knowledge of the Holy One is insight” (Proverbs 9:10).
Can you see the wisdom of God around you? Knowledge of God brings insight! The Psalmist saw God’s wisdom in creation, “O LORD, how manifold are your works! In wisdom have you made them all; the earth is full of your creatures. Here is the sea, great and wide, which teems with creatures innumerable, living things both small and great” (Psalm 104:24-25).
God’s wisdom never fails because God is also powerful. I was amazed at how often God’s wisdom is paired with his power in the Old Testament witness:
With God are wisdom and might; he has counsel and understanding. If he tears down, none can rebuild; if he shuts a man in, none can open. If he withholds the waters, they dry up; if he sends them out, they overwhelm the land. With him are strength and sound wisdom. (Job 12:13-16a; cf. Job 9:4 & Job 36:5)
Daniel answered and said: “Blessed be the name of God forever and ever, to whom belong wisdom and might. He changes times and seasons; he removes kings and sets up kings; he gives wisdom to the wise and knowledge to those who have understanding; he reveals deep and hidden things; he knows what is in the darkness, and the light dwells with him. To you, O God of my fathers, I give thanks and praise, for you have given me wisdom and might, and have now made known to me what we asked of you, for you have made known to us the king’s matter.” Daniel 2:20-23
Packer points out the significance of God being all-wise and all-powerful, “Wisdom without power would be pathetic, a broken reed; power without wisdom would be merely frightening; but in God boundless wisdom and endless power are united, and this makes him utterly worthy of our fullest trust” (Knowing God, pg.91).
Do you trust the wisdom of God? When trials and difficulties fall on you, granted, trusting him can be more difficult because you don’t see the end from your limited human perspective. However, an all loving and all-wise God has a loving and wise purpose for every hurt and pain in your life, as the Apostle Paul clearly experienced and testified:
So to keep me from becoming conceited because of the surpassing greatness of the revelations, a thorn was given me in the flesh, a messenger of Satan to harass me, to keep me from becoming conceited. Three times I pleaded with the Lord about this, that it should leave me. But he said to me, “My grace is sufficient for you, for my power is made perfect in weakness.” Therefore I will boast all the more gladly of my weaknesses, so that the power of Christ may rest upon me (2 Corinthians 12:7-9).
No wonder Paul could worship and praise God for His wisdom and power:
Oh, the depth of the riches and wisdom and knowledge of God! How unsearchable are his judgments and how inscrutable his ways! “For who has known the mind of the Lord, or who has been his counselor?” “Or who has given a gift to him that he might be repaid?” For from him and through him and to him are all things. To him be glory forever. Amen (Romans 11:33-36).
The Psalmist acknowledged God’s wisdom in His creation, Paul recognized and made much of God’s wisdom in His providence, but God’s wisdom shines most brightly in the Gospel message. A loving, just, merciful, and wise God reached down from heaven to save mankind from sin. In the Gospel (I Corinthians 15:1-28) we see God’s wisdom contrasted with convoluted human wisdom:
For the word of the cross is folly to those who are perishing, but to us who are being saved it is the power of God. Recently I had the privilege of sharing James 1:5-6 with a brother in Christ who felt the need to be wiser. The expression of enlightenment and encouragement that shone over his face as he read this verse was amazing, “If any of you lacks wisdom, let him ask God, who gives generously to all without reproach, and it will be given him. But let him ask in faith, with no doubting, for the one who doubts is like a wave of the sea that is driven and tossed by the wind.” We then bowed our heads and prayed, taking heed to the warning to ask with trust and confidence in God. Sensing and knowing our lack of wisdom, and praying for wisdom are good. By doing so, we will see more of God’s wisdom.
Wisdom comes from God because God is wise. What is wisdom? According to J. I. Packer, “Wisdom is the power to see, and the inclination to choose, the best and highest goal, together with the surest means of attaining it. Wisdom is, in fact, the practical side of moral goodness. As such, it is found in its fullness only in God. He alone is naturally and entirely and invariably wise” (Knowing God, pg.90). A wise man once said, “The fear of the LORD is the beginning of wisdom, and the knowledge of the Holy One is insight” (Proverbs 9:10).
Can you see the wisdom of God around you? Knowledge of God brings insight! The Psalmist saw God’s wisdom in creation, “O LORD, how manifold are your works! In wisdom have you made them all; the earth is full of your creatures. Here is the sea, great and wide, which teems with creatures innumerable, living things both small and great” (Psalm 104:24-25).
God’s wisdom never fails because God is also powerful. I was amazed at how often God’s wisdom is paired with his power in the Old Testament witness:
With God are wisdom and might; he has counsel and understanding. If he tears down, none can rebuild; if he shuts a man in, none can open. If he withholds the waters, they dry up; if he sends them out, they overwhelm the land. With him are strength and sound wisdom. (Job 12:13-16a; cf. Job 9:4 & Job 36:5)

He changes times and seasons; he removes kings and sets up kings; he gives wisdom to the wise and knowledge to those who have understanding; he reveals deep and hidden things; he knows what is in the darkness, and the light dwells with him. Packer points out the significance of God being all-wise and all-powerful, “Wisdom without power would be pathetic, a broken reed; power without wisdom would be merely frightening; but in God boundless wisdom and endless power are united, and this makes him utterly worthy of our fullest trust” (Knowing God, pg.91).
Do you trust the wisdom of God? When trials and difficulties fall on you, granted, trusting him can be more difficult because you don’t see the end from your limited human perspective. However, an all loving and all-wise God has a loving and wise purpose for every hurt and pain in your life, as the Apostle Paul clearly experienced and testified:
So to keep me from becoming conceited because of the surpassing greatness of the revelations, a thorn was given me in the flesh, a messenger of Satan to harass me, to keep me from becoming conceited. Three times I pleaded with the Lord about this, that it should leave me. But he said to me, “My grace is sufficient for you, for my power is made perfect in weakness.” Therefore I will boast all the more gladly of my weaknesses, so that the power of Christ may rest upon me (2 Corinthians 12:7-9).
No wonder Paul could worship and praise God for His wisdom and power:
Oh, the depth of the riches and wisdom and knowledge of God! How unsearchable are his judgments and how inscrutable his ways! “For who has known the mind of the Lord, or who has been his counselor?” “Or who has given a gift to him that he might be repaid?” For from him and through him and to him are all things. To him be glory forever. Amen (Romans 11:33-36).
The Psalmist acknowledged God’s wisdom in His creation, Paul recognized and made much of God’s wisdom in His providence, but God’s wisdom shines most brightly in the Gospel message. A loving, just, merciful, and wise God reached down from heaven to save mankind from sin. In the Gospel (I Corinthians 15:1-28) we see God’s wisdom contrasted with convoluted human wisdom:

“President Goodluck Jonathan Lied”

President Goodluck Jonathan’s recent Facebook claim about three weeks of uninterrupted electricity supply to Anambra state capital, Awka, is nowhere near the reality, residents of the town said in a quick rebuttal that again casts doubt on the president’s public claim about his achievements.
Residents from several streets of Awka said while power supply had improved in their areas in the past couple of weeks, the difference was fairly minimal to be regarded as “steady” since interruptions have continued.
“They give us light mostly in the day time and take it during the night when we need it most,” said Mike Nweke, who lives along Zik Avenue, and runs a shop at Eke Awka market. “In spite of the fact that our NEPA credit finishes within days of recharge. There is nothing to celebrate.
Four other residents of the area corroborated that claim of improved power supply over the past three weeks, but they all added that the usual power failure persisted.
At Ifite Awka, mostly habited by students of Nnamdi Azikiwe University, residents said the only difference they witnessed in recent weeks has been the stoppage of the power rationing called “One day ON, one day OFF”, which makes light available to different areas on alternate days.
“Before they use to share light for us and that made us to be having light once in two days but now that has become history because they are now giving us light everyday though the power supply has never been stable as claimed by the president,” one student said.
The responses, randomly drawn from several parts of Awka, particularly refuted the president’s claim about “uninterrupted public power” in a Facebook comment on Thursday.
In the unusual post, which the president said was meant to “drown out the unacceptable negatives in the polity”, Mr. Jonathan highlighted the appointment by telephone company, MTN, of its first Nigerian Chief Executive, as the proceed of his administration’s resolve to build local content; and spoke of steady electricity in Awka, and the registration of the new party, All Progressives Congress, as a reflection of the success of his government’s reforms.
“The second occurrence is the celebration by the city of Awka, in Anambra state of three weeks of uninterrupted public power supply and counting,” Mr. Jonathan wrote. “More cities will soon be able to have such celebrations because the Roadmap to Power Sector Reforms is having the desired effects with almost all of Nigeria’s electricity Distribution companies (Discos) and Generating companies (Gencos) now in private hands as I promised on the 26th of August 2010 in Lagos when I launched the Power Roadmap.”
For a president whose past claims on achievements, particularly about power supply had all turned out fictitious, and were roundly refuted by Nigerians, his remarks about Anambra state immediately stirred swift reactions from Nigerians.
Readers who responded to PREMIUM TIMES’ call on Facebook, asking Awka residents for response, provided mixed opinion of the situation in the commercial state.
While a majority denied the president’s claim, a few admitted the situation had improved.
A respondent, Oraneto Ndubuisi, affirmed, “For real, four weeks now”, while another, Toby Obaji, interjected, “Wait a minute, are you guys trying to say three hours or three weeks. Well, if its three hours …yes, sometimes. If you actually mean three weeks, then it’s not this Awka, might be the Awka in Japan.”
Other residents from different parts of the town, interviewed by our reporter in Awka, returned a verdict that largely disclaimed Mr. Jonathan’s.
At Ogechuckwu Street, five people interviewed said there was no difference in power supply in the area over the past three months because they still used generators at night.
At Emma-Nnaemeka Street, residents also denied there was stable power supply in the area as claimed by the president.
“Enough of that lie and those people presenting those lies to Mr. President should stop it,” one man, visibly angered by the question, said.
In Akoyele Street, one resident who gave his name as Uche, said although an equipment was stolen from the transformer in his neighbourhood weeks ago, resulting in total outage in the area, the situation has only improved to the previous unstable power after residents contributed money to replace the equipment.
“Light no dey my house now as I dey talk to you,” he said in pidgin English.
At Ichida Street, two residents there dismissed the president’s claim as political rhetoric that sought to woo supporters ahead of the forthcoming governorship election in the state.
“I think this is a campaign style of the PDP, they want to use lies to capture Anambra in the forthcoming election and we shall resist them,” a resident who refused to disclose his name said.
Those who spoke at Araba Street, said although they had witnessed a little improvement in power supply over the past few weeks, the power was never stable. One resident in the area further said that while power in the street improved minimally in the past three months, it was “nothing to celebrate”.

Reports reaching us say Ademola Fashola, Lagos state governor Babatunde Fashola’s father, passed away this morning in Lagos.
It seems that he died after battling an illness. It would be recalled that last year, amidst the Lagos Doctors’ strike, he was flown to the United States for medical treatment.

10.1.1 Legal Factors
Any sub-contractor must be willing to enter into a formal and binding form of sub contract under the same terms as the main contractor. As at common law for a contract to exist the following must apply:
Intention – all parties must have intended to enter a binding contract.
There is an offer and an acceptance - both parties must have accepted the agreement.
Consideration - There must be benefit to both parties - one party has a building build, the other receives money for building it.
Certainty – it must be definite
Capacity - Both parties must be able to enter into the contact - they must be over 18 and of sound mind.
Legal -The contract must be legal and be possible to fulfil.
In addition the sub-contractor must fulfil their responsibilities under a number of pieces of legislation. These include:
The Health and Safety At Work Act 1974
This is the primary legislation covering all health and safety in the UK with particular reference to the legal duties of employers, the self-employed and to a lesser extent, employees.
Sub-contractors and their employees have the following responsibilities:
To carry out their works in such a way to ensure, so far as is reasonably practicable, that they and other persons are not exposed to health and safety risks.
To provide information to all persons on site, not just their employees, about the aspects of their work that might affect their health and safety.
To exercise reasonable care for the health and safety of themselves or others who may be affected by their acts or omissions at work
To co-operate with the main contractor, as far as may be necessary, to enable them (the main contractor) to carry out their legal duties in health and safety matters.
The main contractor must check that the sub-contractor adheres to these duties as they (main contractor) are ultimately responsible and liability will rest with them.
The Construction Design and Management (CDM) Regulations 2007
The CDM Regulations place duties on all those who can contribute to the health and safety of a construction project. The Regulations place duties upon clients, designers, contractors and CDM Co-ordinators, and require the production of certain documents - the health and safety plan and the health and safety file.
Sub-contractors and their employees have the following responsibilities:
Plan, manage and monitor own work and that of workers
Check competence of all their appointees and workers
Train own employees
Provide information to their workers
Comply with the specific requirements in Part 4 of the Regulations
Ensure there are adequate welfare facilities for their workers
Check client is aware of duties and a CDM co-ordinator has been appointed and HSE notified before starting work
Co-operate with principal contractor in planning and managing work, including reasonable directions and site rules
Provide details to the principal contractor of any contractor whom he engages in connection with carrying out the work
Provide any information needed for the health and safety file
Inform principal contractor of problems with the plan
Inform principal contractor of reportable accidents, diseases and dangerous occurrences
The main contractor must provide adequate supervision and management to ensure all these duties are adhered to by the sub-contractor as he is liable as the principle contractor.
Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 RIDDOR
Employers, the self-employed and those in control of premises are required by law to report specified workplace incidents, such as work-related deaths, major injuries, 3-day injuries (those causing more than three day’s inability to carry out normal duties), work related diseases, and dangerous occurrences (near miss accidents).
It is a legal requirement to report incidents and ill health at work and the information gathered enables the Health & Safety Executive to gather the information about how and why risks arise and to investigate serious incidents.
Sub-contractors and their employees have the following responsibilities:
To report any work related deaths, injuries, cases of disease, or near misses to the main contractor
Ensure the main contractor reports it to the Health and safety executive
Control of Substances Hazardous to Health Regulations (COSHH).
COSHH requires employers and the self-employed to control exposure to hazardous substances in order to prevent harm to or ill health of employees and non-employees alike.
Sub-contractors and their employees have the following responsibilities:
Assess the risks;
Decide what cautionary measures are needed and put them into action;
Control exposure by measures that are proportionate to the health risk;
Ensure that measures are used and maintained. Cary out checks where necessary;
Monitor the exposure - where adequate control of exposure cannot be achieved provide for suitable personal protective equipment;
Check and review regularly whether all elements of control measures are effective;
Inform and train all employees on the hazards and risks from the substances with which they work and the use of control measures developed to minimise the risks. Prepare procedures to deal with accidents;
Ensure all workers are trained and supervised appropriately.
All the above are carried out in conjunction with the main contractor as he is also responsible for the above duties and for providing any specialist needs, such as storage, so that the sub-contractor is able to comply with these responsibilities.
The Control of Noise at Work Regulations 2005
The Control of Noise at Work Regulations 2005 place a duty on employer's within Great Britain to reduce the risk to their employees’ and the general publics’ health by controlling the noise they are exposed to whilst at work.
Sub-contractors and their employees have the following responsibilities:
Assess the risks to your employees and public from noise at work
Take action to reduce the noise exposure that produces those risks
Provide your employees with hearing protection if you cannot reduce the noise exposure enough by using other methods
Make sure the legal limits on noise exposure are not exceeded
Provide your employees with information, instruction and training
Carry out health surveillance where there is a risk to health.
These duties also apply to the main contractor but also they must ensure they pay particular attention to noise levels on site.

10.1.2 Types of sub-contractor
Not all the work on a contract will be carried out by the main contractor. These days it is common to sub-contract various aspects of the job to other companies although the main contractor retains overall control and in most case responsibility. The most common reason for sub-contracting is due the main contractor not having the required skills within its own work force, although more and more theses day reduce the amount of directly employed labour due to financial reasons.
There are four types of subcontractors:
Domestic Sub-contractor
A Domestic Sub-contractor is selected and engaged directly by the main contractor to carry out a particular trade, this will mainly include standard trades such as bricklayers, roofers, ground workers, plumbers, electrical and plasterers. They may be labour only or supply and fix. In all cases they must be approved by the architect under JCT 2005 Standard Building Contracts. The architect has the full authority to reject any subcontractor requested by the contractor. The contract does not recognise the main contractors own subcontractors, any work carried out by these is taken as if it were carried out by the main contractor.
Nominated Sub-contractor
A Nominated subcontractor is chosen by the architect, client or engineer to carry out certain aspects of the work. They are appointed on the expenditure of a provisional sum or prime cost sum included in the contract bills. The nominated subcontractor enters into a contract with the main contractor but there may be a collateral warranty between the nominated subcontractor and the client. The main contractor has no responsibility to carry our work that is intended to be carried out by a nominated subcontractor. Nomination is not possible under the JCT 2005 Standard Building Contracts or the Engineering and Construction Contract. The main contractor is required to provide the general attendances for the subcontractor; any special attendances are the subcontractors’ responsibility. The main contractor will provide a profit margin for such attendance.
Named Sub-contractor
A named sub-contractor will often be chosen from a list of subcontractors provided by the architect. Under the JCT 05 standard or intermediate building contracts, the architect may provide the contractor with a list of at least three subcontractors to choose from for carrying out particular parts. The main contractor may, with approval from the architect, add subcontractors to the list. Although the subcontractor is named, they are a domestic subcontractor under the contract.
Labour only Sub-contractor
Labour only Sub-contractor includes self-employed individuals, agencies and small firms. It is useful in that it enables the contractor to take on temporary workers as and when required. This will reduce the overheads in that they are only paid when working and there is not national insurance contribution. It is essential to take care in selecting as there can be problems with regard to quality of work and safety awareness.

10.1.3 Attendance
When a sub-contractor is used it falls to the main contractor to provide the sub-contractor with certain facilities and assistance, this is known as Attendance. This can fall into general attendances such as:
Power and Water
Welfare facilities
Toilets
Site parking
Secure plant and material storage
In addition specific types of attendance may be required so these will need to be identified.

Sub-Contractors must provide their own specialist equipment which is not generally on site and this should be agreed before commencement.
Sub-Contractors materials are the responsibility of Sub-Contractors although the Main Contractor may unload and distribute it. Any requirements with regard storage must be agreed from the onset, as must the provision of any steps, trestles and towers below 3.3M

Students persuade President Jonathan’s Intervention In Lingering ASUU Strike

Students of the Ebonyi State University (EBSU) on Friday begged President Gooodluck Jonathan to wade into the lingering ASUU and Federal Government crisis.
The students said that they looked up to Mr President to personally intervene in the face-off.
Mr Louis Onwe, a 300-level biochemistry student said: ‘’His intervention into the ongoing crisis will lead to timely resolution of the impasse and resumption of academic work.’’
He said that since the president enjoyed enormous goodwill with the union, it would listen to him if he intervened personally in the face-off.
“ASUU demands are quite germane as it will boost research and development of infrastructures in the universities,’’ Onwe said.
Mr Kelechukwu Anyigor, also a 300-level student of biochemistry, said they were optimistic that Jonathan’s intervention was needed to quickly resolve the strike.
“Our president enjoys tremendous goodwill because of his human rights records, and his attempt to reposition the country’s economy.
“It is our candid belief that if he personally intervenes in the matter, ASUU will listen to him in the interest of the students and the nation at large,’’ Anyigor said.
Mr Michael Otuu of the Department of Business Administration, called on the president to rise above politics and wade into the crisis in the interest of Nigerian students and university education.
According to him, the indefinite strike already in its fifth week is having a negative toll on the academic pursuit of university students in the country.
Otuu called on well meaning Nigerians to prevail on the federal government to accede to the demands of ASUU in the interest of industrial harmony in the system.
The National President of ASUU, Dr Isa Fagge, declared a nationwide indefinite strike on July 1 to protest the failure of the government to honour the 2009 agreements it reached with ASUU. [NAN]
